CTP Insurance for Injury
Motor accident injury compensation in Queensland covers personal injuries caused by motor accidents (CTP insurance). It is generally a fault based insurance scheme. This means an innocent victim can recover injury compensation from the CTP insurer of the at-fault driver. For some very serious injuries even an at-fault driver may have some entitlement to compensation or benefits.
Compensation for Hit and Run Accidents
Spinal, shoulder and psychiatric injuries are the most common injuries caused by motor accidents, but there are also a wide variety of less common injuries or other injuries caused by more severe accidents. Motor accident injury compensation also covers injuries caused by hit and run accidents where the identity of the at-fault driver is unknown. However, for this type of claim against the Nominal Defendant, short and strictly enforced time limits apply so you should not delay in seeking legal advice.
What to Do After an Accident
Establishing who caused the accident is often much less complicated than in other types of claims and in many cases the legal costs will therefore be lower. However, if you have been involved in a motor accident, as soon as reasonably possible you should record the registration of the at-fault vehicle and, if possible, take down the driver’s details. Take photos of the other vehicle that show it’s registration, make, model and the crash damage. Then take photos of the same for your own vehicle. If possible, ask to photograph the other driver’s license so you have their identity to report to the police. Then take photos that show the surrounding area to put the positions of the vehicles in context. The type and extent of crash damage can be relevant to proving the full extent of your injuries as well as who caused the accident.
Police Report and Medical Attention
Motor accidents and injuries must be reported to a doctor and the police as reports from both are needed to start a CTP personal injury claim. In some cases the majority of your legal costs can be recovered from the CTP insurer and any motor accident injury compensation claim that is worth your while pursuing is one we would be happy to assist with on a no win no fee basis.
